KELTON M. BURGESS

ATTORNEY AT LAW

My name is Kelton M. Burgess. I am an Estate Planning and Probate attorney. My path to becoming a top-notch lawyer has been filled with many unique experiences, each of which shaped me into the legal professional I am today.
I earned my Juris Doctorate from Duquesne University School of Law in 2004, where I served as the Graduate Research Assistant to the Dean and was a National Finalist on the Moot Court Team. After law school, I became licensed to practice law in Pennsylvania and California.
My law career began at a AM LAW 100 National insurance defense litigation firm in San Francisco, where I accrued nearly a decade of experience fighting for large companies. I then went on to work at a boutique law firm, where I served as counsel on several highly-publicized cases. In 2012, I opened my own firm, the Law Offices of Kelton M. Burgess, LLC, with the intention of serving the needs of those facing the estate planning, asset protection and probate processes.
I am dedicated to giving back to the community and participate on several boards. Currently, I serve on the Allegheny County Bar Association (ACBA) Probate and Trust Law Council, the ACBA Strategic Planning Committee and the Attorneys Against Hunger Committee.
I am a member of the Board of Governors for the Western Pennsylvania Trial Lawyers Association, mentor young lawyers and law students. I routinely appears at seminars and lectures throughout the Greater Pittsburgh Area, providing education to people in my community from all walks of life.
In my spare time, I am a husband and father. My interests include spending time with my family, skiing, golf, cooking and all the things a suburban dad does.
While my credentials are impressive, what truly sets me apart is my human approach to the law. I treat my clients as individuals, not case numbers. When the emotional aspects of estate planning or probate become overwhelming, I am here to offer support, strength, and a listening ear. You focus on your well-being during this difficult time—and I will handle the legalities.

COMMON PROBATE QUESTIONS

MY SPOUSE DIED.
WILL I LOSE MY HOME?

If you jointly owned your home or your spouse named you as the beneficiary of the home, you have the right of survivorship.

What happens if my loved one didn’t have a will?

If your loved one passed away without a will, Pennsylvania intestate laws will be applied. These laws use a formula to distribute the decedent’s property, and the personal representative will be instructed to follow this formula regardless of your loved one’s final wishes.

START SEEKING A PATH FORWARD

You’ve worked incredibly hard to build a stable life, not only to benefit yourself, but to benefit the generations to come. However, unless you put the necessary protections in place to ensure that your estate will be properly transferred upon your death, the state will have control over who receives your assets.

By putting together a comprehensive estate plan, you can rest easy knowing that your estate will be administered according to your final wishes, not state law. In addition, having legal documents like irrevocable trusts in place can help your family members avoid the difficult probate process down the line.
